GENERAL CONDITIONS FOR CLEANING OF AIR CONDITIONERS
Purify Air Con Cleaning cannot be held responsible for any pre-existing condition that is not apparent upon visual inspection.
**Cancellation of an air con treatment less than 24 hours before the scheduled appointment will attract a $100 + GST cancellation fee.
These conditions may include but are not limited to:
Customer must allow for reasonable access and clearance to all Air Con Units to be cleaned.
Faulty Remote Controls, Exhausted Batteries or Corrosion.
Faulty Printed Circuit Boards in the Evaporator/Condenser.
Worn Airflow Louver Motors or Brittle Louvers / Filters due to age or Poor Maintenance.
Any Air Conditioner over 7 years of age, the Customer understands there is a risk providing any maintenance to aged equipment and accepts that any failures due to aged components indemnifies Purify Air Con Cleaning from liability.
Faulty or Deteriorated Pipe Insulation or lagging.
Faulty or Damaged Electrical Cabling or Circuit Isolating Switches.
Condensate Pump Failure or leaking where fitted post cleaning.
Any damage caused to furniture when assisting in removal to enable access to work site.
Where Air Conditioners are cleaned that have wall mounted televisions below the Air Conditioner, no liability will be accepted for any damage caused by the condensate leaking, in any period post service.
It is the recommendation of Purify Air Con Cleaning that no flat screen television or wall mounted monitor be wall mounted directly under an air conditioning evaporator.
Poorly mounted or unprofessional fixing of evaporators to walls or ceilings. Purify Air Con Cleaning will not be held liable for any system damage due to incorrect wall or ceiling fixing of HVAC equipment.
Purify Air Con Cleaning will only warrant claims with respect to the workmanship of the services provided if the claim is reported within 5 working days of completion of the work. In the event of customer complaint, the customer undertakes to give Purify Air Con Cleaning the opportunity to rectify all work.
GENERAL TERMS AND CONDITIONS FOR MOULD AND COVID TREATMENT PRODUCTS & SERVICES
By using this Site, you indicate that you have read and understood these Terms and Conditions and agree to abide by them at all times.
Sale of Goods And Services
These Terms and Conditions govern the sale of goods and services available on our Site.
These Terms and Conditions apply to all the goods and services that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods and services are as accurate as possible.
However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods and services we provide. You agree to purchase goods and services from our Site at your own risk.
We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

Fogging Specific Terms and Conditions:
Purify Air Fogging Treatment is guaranteed to remove COVID-19 on all surfaces for a minimum of 30 days.
Purify Air Fogging Treatment is guaranteed to treat mould for up to 12 months, as long as our advice is adhered to:
> You must ventilate the room/house
> You must stop the source of moisture (ie. rising damp, leaking tap, leaking roof etc)
Failing to do so will encourage mould to return and your warranty will be void.
* To claim the warranty, you must show what definitive actions you have taken to mitigate the damp situation. All claims must be fair and reasonable.
Third Party Goods and Services
Our Site may offer goods and services from third parties. We cannot guarantee the quality or accuracy of goods and services made available by third parties on our Site.
The following goods are available on our Site:
4in1 + Protector;
Hand Sanitiser + Protector; and
The goods will be paid for in full when the goods are ordered.
We accept the following payment methods on our Site:
Credit/Debit Card .
When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.
If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.
Shipping and Delivery
When you purchase goods from our Site, the goods will be delivered through one of the following methods:
Standard delivery by post. Delivery takes 5 - 7 business days.
Delivery will take place as soon as reasonably possible, depending on the delivery method selected. Delivery times may vary due to unforseen circumstances. Please note that delivery times do not include weekends and public holidays.
You will be required to pay delivery charges in addition to the price for the goods you purchase.
If you purchase goods from us for delivery to a destination outside Australia your purchase may be subject to import duties and taxes applied by the destination country. You are responsible for paying any such duties or taxes. Please contact your local customs office for more information before making a purchase. We are not responsible for the payment of any such duties or taxes and are not liable for any failure by you to pay them.
You are required to provide us with a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us with inaccurate or incomplete information.
Refund requests must be made within 14 days after receipt of your goods.
We accept refund requests for goods sold on our Site for any of the following reasons:

Good does not match the description

Consumer Protection Law
Where the Australian Consumer Law, Schedule 2 of the Competition and Consumer Act 2010, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Limitation of Liability
Purify Air and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.
Except where prohibited by law, by using this Site you indemnify and hold harmless Purify Air and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.
These Terms and Conditions are governed by the laws of the State of Queensland.
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
GENERAL TERMS AND CONDITIONS FOR AIR PURIFIERS
All orders between Purify Air Pty Ltd, as a distributer for The Clean Air Company Pty Ltd, and the Buyer whether written or verbal are accepted by Purify Air subject to the Goods being available and subject also to these Conditions applying. In the event of any inconsistency between these Conditions and any conditions on which the Buyer may seek to rely, these Conditions shall prevail and will override any conditions of purchase of the Buyer including any conditions which may appear on the Buyer's order form or similar documentation, unless agreed by Purify Air in writing. Acceptance of a Quotation or acknowledgment of order by the Buyer is deemed acceptance of these Conditions. An order accepted by Purify Air cannot be cancelled, deferred or altered except by mutual agreement and confirmed in writing by both parties and is subject to agreement on costs incurred.
All prices quoted are valid for a period of one month from the date of a Quotation or from the date of issue of price lists unless otherwise expressly stated in the quotation or price list. All prices are subject to GST at the rate current at the time of delivery. Authority fees including any Duty, AQIS, customs or related authority or government department or agency fees are excluded from our quotation and will be paid by the buyer.
All prices quoted are net trade prices and shall not be subject to retention or net discount, unless specifically stated in a Quotation or Acknowledgement of Order.
Purify Air will use its reasonable endeavours to make deliveries of Goods on a date or dates agreed. Purify Air does not accept any responsibility or liability for failure to deliver or for any delay in delivering Goods in accordance with the order unless otherwise agreed in writing before delivery. Frustrated deliveries created by the supply to Purify Air of incorrect delivery details including location, time or other information that is not correct, will incur a redelivery fee charged by the selected carrier plus a 15% (plus gst) handling fee. This must be paid by the customer upon issue of Purify Air invoice for same or the purchase will be considered incomplete.
The Buyer shall not be entitled to issue a claim against Purify Air in relation to alleged damaged Goods or alleged shortages of Goods unless the Buyer has notified Purify Air in writing of the alleged defects/shortages within 48 hours of delivery. The Buyer must notify Purify Air in writing directly about any damage or perceived damage to Goods (including packaging) relating to carriage.
The Buyer will not be entitled to return Goods to Purify Air unless Purify Air has agreed before any such return. . Should Purify Air agree to accept returned Goods, the Buyer shall be liable to pay a restocking charge amounting to 15% of the agreed purchase price for the Goods. Goods returned must be in as-new condition in their original cartons.
Risk and Insurance
The risk in the Goods shall pass to the Buyer from the time of delivery to the Buyer’s address or other agreed place of delivery or on collection by the Buyer as appropriate notwithstanding that property in the Goods may be retained by Purify Air in accordance with Clauses 11 and 12. The Buyer shall be responsible for effecting its own insurance as appropriate from the date of delivery of any Goods. Once the Goods have been delivered or Services have been installed the Buyer shall be responsible for fully protecting them and keeping safe the Goods and Services. The risk and responsibility of the Buyer in this regard also extends and applies to the return where applicable of any Goods to Purify Air and the Buyer in such a case shall be so responsible to the time of acceptance of the returned Goods and/or Services by Purify Air.
Prices Of Goods and Services
The Goods and Services shall be supplied in accordance with the Purify Air quotation and the price shall not be subject to reduction or variation unless agreed in writing. The Buyer shall not be entitled to apply any set off against any sums owing to Purify Air.
Terms Of Payment
OUR TERMS OF PAYMENT ARE AS FOLLOWS:
• AS PER QUOTATION
• ALL VARIATIONS NOT INCLUDED IN THE CONTRACT MAY BE CHARGED SEPARATELY AND ARE IN ADDITION TO THE AMOUNT QUOTED.
• ALL INVOICES ARE PAYABLE WITHIN 30 DAYS FROM THE INVOICE DATE.
• AMOUNTS UNPAID BEYOND 30 DAYS ARE SUBJECT TO INTEREST CALCULATED AT THE VARIABLE INTEREST RATE PUBLISHED BY WESTPAC BANK FROM TIME TO TIME ON OVERDRAFT AMOUNTS EXCEEDING $100,000 PLUS 2%
• ANY INVOICE QUERIES SHALL BE NOTIFIED WITHIN 7 DAYS FROM RECEIPT OF INVOICE, OTHERWISE THE INVOICE AMOUNT IS DEEMED TO BE ACCEPTED.
• If part of an Invoice is disputed by the Buyer for good cause, only the disputed part may be withheld and the balance must be paid by the due date.
• Where part delivery or part service work is carried out, an Application for Payment on Account will be made and payment is due to Purify Air 7 days from the date of the Application.
• Payments may be made by Electronic Funds Transfer (EFT) as Purify Air directs.
• If the Buyer fails to make any payment by the due date then without prejudice to any other rights or remedies available Purify Air reserves the right to:
(i) Cancel the order or suspend any further deliveries of Goods and/ or Services.
(ii) Take down and retrieve any Goods or systems not affixed or installed.
Retention Of Title and Passing Of Property
(a) Ownership in the Goods shall remain with Purify Air until full payment for the Goods and/or Services has been received by Purify Air.
(b) Until such time, the Buyer shall keep the Goods free from any charge, lien or other encumbrance whatsoever and the Buyer shall hold the Goods as bailee for Purify Air.
(c) Furthermore, the Buyer shall store the Goods owned by Purify Air separately from its own.
(d) Until payment in full for the Goods and Services has been received, Purify Air may at any time require the Goods to be returned to it and if such requirement is not complied with forthwith it may retake possession of the Goods and for such purposes is irrevocably authorised to enter upon any premises whether or not occupied by the Buyer and retrieve the Goods without in anyway being liable to the Buyer.
(e) Where Purify Air has exercised its rights in relation to retaking possession of the Goods Purify Air may re-sell the Goods to a third party.
Quality and Purpose
The Goods are warranted in accordance with the specification set out in Purify Air’s Quotation or in its Guarantee Document which is available upon request, or if there is no such specification, to be within normal limits of quality or description, statutory or otherwise. While all product information is given in good faith, the use or application of the Goods and /or Services is outside the control of Purify Air and accordingly Purify Air gives no warranty as to the fitness of the Goods or Services for any particular purpose and any implied warranty or condition (statutory or otherwise) is excluded insofar as such exclusion is permitted by law. Purify Air’s liability in respect of the quality or fitness for the purpose of the Goods or Services supplied shall not extend to the Buyer’s loss of profits, increased cost or work or any other consequential loss. Any liability arising in connection with the order owed by Purify Air to the Buyer shall at all times be limited to the value of the Goods and/or Services (as the case may be) and shall not exceed an amount which is just and equitable taking into account the relative contributions to any loss suffered by the Buyer of Purify Air and other parties who have entered into any arrangements (contractual or otherwise) with the Buyer.
Notwithstanding any agreement to the contrary, any delivery may be totally or partially suspended by Purify Air as a result of delay in manufacture, supply or delivery arising from acts of God, unforeseeable circumstances, acts of Government or local authority, war, revolution, fires, ice, strikes, industrial disputes, inability to obtain necessary and/or proper materials, facilities, transportation or labour or any other cause beyond Purify Air’s control. Any Goods, the delivery of which has not been totally or partially suspended shall be accepted by the Buyer as soon as it is reasonably practicable after the reason for delay has abated.
